How can we help with a Property Transaction?

At Small Myers Hughes, our strata lawyers have a wide range of experience in general property law and transactions and understand intimately the requirements for these transactions within the context of strata and community titles schemes.

We frequently assist owners, bodies corporate and developers wishing to conduct property transactions within strata and community schemes in both Queensland and New South Wales, including:

  • Subdividing lots and common property
  • Removing lots and common property from a scheme
  • Adding lots and common property to a scheme
  • Amalgamating schemes
  • Creating a layered arrangement of schemes from existing basic schemes
  • Easements
  • Leases
  • Licenses
  • Exclusive use grants and transpositions

Having a body corporate involved in these types of transactions adds a layer of complexity to the transaction as they trigger special legislative requirements that must be complied with in order to ensure the transaction is properly carried out and effective. It is important to ensure that you get the proper body corporate and council approvals, appropriately update the scheme’s community management statement (where necessary) and ensure that all aspects of the transaction (such as stamp duty and mortgagee consent) are properly considered.

We guide clients through the entire process from start to finish and can recommend or engage appropriate consultants (e.g. town planner or surveyor) to take the stress out of the process and ensure that the transaction runs smoothly and efficiently.
